My employee wants a copy of her personnel file. Do I have to give it to her?

Yes. Minnesota law gives employees, of companies with 20 or more employees, the right to a copy of the contents of their personnel file every six months. The employee can also see it when her employment ends and once a year so long as the file is maintained.

After a written request by the employee, Minnesota law requires you to make a copy available for review within seven business days (14 days if the file is located outside Minnesota).

Bonus Tip-What constitutes the employee's "personnel file" is defined by Minnesota law and may include more or less than what your company puts into the file.
